On September 5, 2012, Vivaro and its affiliates filed voluntary petitions for relief under chapter 11 of the Bankruptcy Code in the United States Bankruptcy Court for the Southern District of New York, jointly administered under Case No. 12-13810. Thereafter, on September 13, 2016, the Court confirmed a Joint chapter 11 Plan pursuant to which the Creditor Trust of Vivaro Corporation was created. Oak Point Partners, Inc. acquired the remnant assets of the Creditor Trust of Vivaro Corporation in August 2017.
